Terms and Conditions

1. Introduction
These Terms and Conditions govern your use of Dee. By installing, accessing, or using Dee, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.
Dee is operated by Decentralized Exploration Limited, British Virgin Islands ("the publisher").
2. Nature of the Service
Dee is a self-custodial wallet app that provides a non-custodial interface to the Hyperliquid network. Your wallet connects to the network directly from your device. Dee does not:
- (a) operate as a custodian of digital assets;
- (b) hold or control user funds;
- (c) have access to your private keys or seed phrases — keys are generated and stored only on your device (and, if you enable it, in your iCloud Keychain);
- (d) provide legal, financial, or tax advice;
- (e) act as a broker, dealer, exchange, or traditional financial institution.
You interact directly with blockchain networks, smart contracts, and third-party protocols when initiating or managing transfers and trades.
Creating or importing a wallet in Dee does not create an account with the publisher or on the Hyperliquid network. A wallet address becomes an active Hyperliquid account only when the network credits its first USDC transfer; until then, trading authorization cannot be granted and no trading is possible.
3. Eligibility
By using Dee, you represent and warrant that:
- (a) you are at least 18 years of age or the legal age of majority in your jurisdiction;
- (b) you are legally permitted to use Dee and to trade digital assets under the laws applicable to you;
- (c) you are not using Dee from a jurisdiction where such use is prohibited or restricted, including but not limited to the United States of America, North Korea, Iran, and other sanctioned regions;
- (d) you are not on any sanctions or restricted parties list (e.g., OFAC, UN, EU sanctions lists).
When connecting to the Hyperliquid network you are also subject to Hyperliquid's own terms of use, including its restrictions on eligible persons.
You are solely responsible for determining whether and how you can use Dee in compliance with local laws and regulations.
4. Non-Custodial and User Responsibility
Dee is non-custodial. The publisher does not manage or store private keys, seed phrases, wallets, or funds. All blockchain transactions are signed with keys stored on your device and controlled solely by you.
You are solely responsible for:
- (a) safeguarding your wallet, private keys, seed phrases, and device passcodes;
- (b) understanding how the wallet, blockchain, and smart contracts work;
- (c) confirming all transaction details before signing and broadcasting;
- (d) backing up and securing access to your wallet.
If you lose access to your wallet, private keys, or seed phrases, the publisher cannot recover your assets or restore your access.
5. No Financial, Investment, or Trading Advice
Dee may display charts, market data, statistics, analytics, portfolio overviews, or notifications. Such information is provided solely for informational and user interface purposes. It does not constitute financial, investment, legal, or tax advice.
You acknowledge and agree that:
- (a) all trading and investment decisions are your own;
- (b) you should conduct your own research and, if needed, consult professional advisors;
- (c) the publisher is not responsible for any decisions you make based on information displayed in the App.
6. Trading and Market Risks
Trading digital assets, including leveraged perpetual contracts, involves substantial risk. You may experience rapid market movements, liquidation of positions, partial or total loss of capital, price slippage, high volatility, and other risks.
By using Dee, you acknowledge and accept that:
- (a) the value of digital assets can fluctuate significantly;
- (b) past performance is not indicative of future results;
- (c) you may lose some or all of the funds you trade;
- (d) automated liquidation engines may close your positions at loss without prior notice if maintenance margin requirements are not met;
- (e) you may incur network fees, protocol fees, funding payments, trading fees (including builder fees collected through protocol mechanisms), or other charges;
- (f) you trade and interact with protocols entirely at your own risk.
The publisher does not guarantee any profit, return, or outcome.
7. Third-Party Protocols and Smart Contracts
Dee may enable interaction with third-party protocols, smart contracts, or networks, including but not limited to the Hyperliquid network, Circle CCTP, EVM networks, and the Solana network. These are not developed, controlled, or audited by the publisher.
You understand and agree that:
- (a) smart contracts and protocols may contain bugs, vulnerabilities, or logic errors;
- (b) there may be hacks, exploits, or failures beyond Dee's control;
- (c) protocol changes, forks, or governance decisions may affect your positions and assets.
The publisher is not responsible for any loss or damage arising from third-party protocols, smart contracts, or network behavior.
8. Service Availability
Dee may be subject to interruptions, delays, or errors due to maintenance, technical issues, network congestion, or external events. The publisher does not guarantee that Dee will be available at all times or that it will be free from errors or defects.
You understand that access to blockchain networks, price feeds, and related infrastructure may be impacted by events outside our control.
9. Prohibited Uses
You agree not to use Dee for illegal, fraudulent, or abusive purposes. This includes:
- (a) using Dee in violation of applicable laws or regulations;
- (b) engaging in market manipulation, wash trading, spoofing, front-running, or other abusive trading behavior;
- (c) attempting to interfere with the security, integrity, or performance of Dee (e.g., via DDoS attacks or bot spamming);
- (d) attempting to access or tamper with wallets or data that do not belong to you.
The publisher may restrict or terminate your access to Dee if it reasonably believes you have violated these Terms.
10. Intellectual Property
All trademarks, logos, branding, design elements, user interface layouts, text, graphics, and other content associated with Dee are owned or licensed by the publisher. Third-party names, logos, and asset symbols are the property of their respective owners and are displayed solely to identify networks, protocols, and markets.
You may use Dee only for its intended purpose and in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, or create derivative works of Dee or its content, except as allowed by applicable law.
11. Disclaimer of Warranties
Dee is provided on an as is and as available basis.
The publisher makes no representations or warranties of any kind, express or implied, including but not limited to:
- (a) warranties of merchantability;
- (b) fitness for a particular purpose;
- (c) non-infringement;
- (d) accuracy, completeness, or reliability of market data or information;
- (e) uninterrupted or error-free operation.
You use Dee at your own risk.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- (a) the publisher and its directors, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of data, or loss of opportunity, arising out of or in connection with your use of Dee;
- (b) the publisher shall not be liable for any losses caused by market volatility, liquidation events, slippage, network congestion, smart contract failures, hacks, protocol exploits, or any actions or omissions of third parties;
- (c) the publisher shall not be liable for any loss of funds or access due to lost private keys, seed phrases, wallet credentials, device failure, or user error;
- (d) the publisher's total aggregate liability for any claim arising out of or relating to Dee shall not exceed zero (0) USD, to the fullest extent allowed by law.
If applicable law does not allow certain limitations, the liability of the publisher will be limited to the minimum extent permitted by law.
13. User Assumption of Risk
By using Dee, you:
- (a) acknowledge that you understand the risks associated with digital assets and decentralized protocols;
- (b) agree that you assume full responsibility for all transactions and interactions through Dee;
- (c) agree that the publisher is not responsible for any consequences of your decisions or actions on-chain.
14. Indemnification
You agree to indemnify, defend, and hold harmless the publisher and its directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- (a) your use or misuse of Dee;
- (b) your violation of these Terms and Conditions;
- (c) your violation of any law or regulation;
- (d) your interaction with third-party protocols, networks, or services through Dee.
15. Termination
The publisher may modify, suspend, or terminate access to Dee at any time, with or without notice, where permitted by law. You may stop using Dee at any time by uninstalling the App. Because Dee is self-custodial, this does not affect your on-chain assets: your recovery phrase can restore your wallet in any compatible wallet software.
Sections of these Terms that by their nature should survive termination, including limitation of liability, indemnification, intellectual property, and governing law, shall continue to apply.
16. Changes to These Terms
The publisher may update or modify these Terms and Conditions from time to time. The latest version will be made available via the App or at https://dee.xyz. Your continued use of Dee after any changes are posted constitutes your acceptance of the updated Terms.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the British Virgin Islands, without regard to its conflict of law principles.
Any disputes arising out of or in connection with Dee shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands, unless otherwise required by applicable law.
